Terms of Service for Carolina Women in Tech® Events
These Terms of Service (“Terms”) govern your registration for and participation in events (“Events”) organized by Carolina Women in Tech®, a non-profit organization located at 217 Dunbar St. Charlotte, NC 28203 (“we,” “us,” or “our”). By registering for or participating in any of our Events, you agree to be bound by these Terms.
1. Event Registration
- Accuracy of Information: You agree to provide accurate, current, and complete information during the registration process. You are solely responsible for any errors or omissions in the information you provide.
- Eligibility: Events may have specific eligibility requirements (e.g., age restrictions, professional qualifications). You agree to meet all stated eligibility criteria for the Event you register for.
- Registration Confirmation: Your registration is not complete until you receive a confirmation from us.
- Payment (if applicable): If an Event requires a fee, payment must be made in full by the specified deadline. All payments are non-refundable unless otherwise stated in our Cancellation and Refund Policy.
2. Event Participation
- Conduct: You agree to conduct yourself in a respectful, professional, and safe manner at all Events. Disruptive, harassing, discriminatory, or illegal behavior will not be tolerated. We reserve the right to remove any participant from an Event for violating these Terms without a refund.
- Compliance with Laws: You agree to comply with all applicable laws, regulations, and venue rules during your participation in our Events.
- Intellectual Property: All intellectual property rights related to Event content, materials, and presentations belong to Carolina Women in Tech® or the respective presenters. You may not record, reproduce, distribute, or otherwise use Event content without our express written permission.
- Photography and Videography: By attending an Event, you acknowledge and agree that you may be photographed or videotaped by us or our authorized representatives. You grant us permission to use such photographs and videos for promotional, educational, and archival purposes, including on our website and social media, without compensation to you. If you do not wish to be photographed or videotaped, please notify us in writing prior to the Event or inform a staff member at the Event. We will make reasonable efforts to accommodate your request, but cannot guarantee that you will not be incidentally included in photos or videos.
3. Cancellations and Refunds
- Cancellation by You: Cancellations made 5 days or more before the Event will receive a full refund. Cancellations made less than 5 days before the Event are non-refundable.
- Cancellation by Us: We reserve the right to cancel or reschedule an Event at any time due to unforeseen circumstances, low enrollment, or other reasons. In the event of cancellation by us, registered participants will receive a full refund of any fees paid. We are not responsible for any other costs incurred by you (e.g., travel, accommodation) as a result of an Event cancellation.
- Changes to Events: We reserve the right to modify Event schedules, speakers, content, or venues at any time. We will endeavor to provide timely notice of any significant changes.
4. Disclaimer of Warranties
ALL EVENTS AND RELATED MATERIALS ARE PROVIDED ON AN “AS-IS” AND “AS-AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT EVENTS WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED.
5. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, Carolina Women in Tech® AND ITS DIRECTORS, OFFICERS, EMPLOYEES, VOLUNTEERS, AND AGENTS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE EVENTS; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE EVENTS; (III) ANY CONTENT OBTAINED FROM THE EVENTS; AND (IV) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.
6. Indemnification
You agree to indemnify, defend, and hold harmless Carolina Women in Tech® and its directors, officers, employees, volunteers, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) that such parties may incur as a result of or arising from your (or anyone using your account’s) violation of these Terms.
7. Privacy
Your privacy is important to us. Please refer to our Privacy Policy for information on how we collect, use, and disclose your personal information.
8. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the State of North and South Carolina, without regard to its conflict of law principles. Any legal action or proceeding arising out of or related to these Terms or your participation in our Events shall be brought exclusively in the state or federal courts located in Mecklenburg County, NC.
9. Severability
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
10. Entire Agreement
These Terms constitute the entire agreement between you and Carolina Women in Tech® regarding your participation in our Events and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding such subject matter.
11. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on our website Carolinawomenintech.org or by other reasonable means. Your continued participation in our Events after any such modifications constitutes your acceptance of the revised Terms.
